Terms & Conditions

1. Introduction

These Terms & Conditions (“Terms”) govern your use of the JobFlow platform (“Service”), provided by HYDRO TECH FORKLIFT(“we”, “us”, “our”), a company registered in the Republic of South Africa.

By creating an account or using JobFlow, you agree to these Terms. If you do not agree, do not use the Service.

2. Service Description

JobFlow is a job card management platform for South African businesses. It provides:

• Job card creation, tracking, and management
• Quoting and invoicing with South African VAT compliance
• Client, vehicle, and equipment management
• AI-powered voice-to-text job card filling
• Bank statement import and payment matching
• Team management with role-based access (office, technician, bookkeeper)
• Offline-capable mobile access for field technicians

Features available depend on your subscription tier. We reserve the right to modify, add, or remove features with reasonable notice.

3. Account Registration

• You must provide accurate, complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity under your account.
• You must be at least 18 years old and capable of entering into a binding contract.
• One account per company. Additional users are added through team management.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions & Payment

• JobFlow offers tiered subscription plans. Current pricing is published on our Pricing page.
• All prices are in South African Rand (ZAR) and exclude VAT.
• Subscriptions are billed monthly in advance.
• Payment is processed through secure third-party payment gateways. We do not store full credit card details.
• You must maintain a valid payment method. Failed payments may result in service suspension.
• We reserve the right to change pricing with 30 days’ notice. Existing subscribers will be notified.

5. Free Trial

• New accounts receive a 7-day free trial with full access to features.
• No payment method is required during the trial.
• At the end of the trial, you must subscribe to continue using the Service.
• We reserve the right to modify or end the free trial offer at any time.

6. Cancellation & Refunds

Our cancellation and refund policy is detailed on ourRefunds page. Key points:

• You may cancel your subscription at any time from your Settings page.
• Cancellation takes effect at the end of the current billing period. No prorated refunds for unused time.
• You retain access to your data for 30 days after cancellation for export purposes.

7. Acceptable Use

You agree not to:

• Use JobFlow for any unlawful purpose or in violation of South African law.
• Upload or transmit viruses, malware, or malicious code.
• Attempt to gain unauthorized access to other users’ accounts or data.
• Resell, sublicense, or redistribute the Service without written permission.
• Use the Service to send spam, unsolicited communications, or harass others.
• Exceed reasonable usage limits that degrade the Service for other users.

8. Your Data

• You retain full ownership of all data you enter into JobFlow (clients, job cards, invoices, etc.).
• We store your data securely on Supabase servers. See ourPrivacy Policy for details.
• Upon account termination, your data is permanently deleted within 30 days.
• You may export your data at any time during your subscription and within 30 days after cancellation.
• We do not share your business data with third parties except as required for service operation (hosting, email delivery).

9. Intellectual Property

• JobFlow, including its code, design, logo, and branding, is our intellectual property.
• You may not copy, modify, or reverse engineer any part of the Service.
• Your company logo and business name, as uploaded to JobFlow, remain your intellectual property.
• You grant us a limited license to display your company name and logo within your account and on client-facing documents (invoices, quotes, statements) generated through the Service.

10. Limitation of Liability

To the fullest extent permitted by South African law:

• JobFlow is provided “as is” without warranties of any kind, express or implied.
• We do not guarantee uninterrupted, error-free service. We strive for 99% uptime but cannot guarantee it.
• Revenue loss: We are not liable for any loss of revenue, profit, business, or anticipated savings arising from your use or inability to use the Service.
• Data loss: We are not liable for any loss of or corruption of data. However, we maintain regular automated database backups and will make reasonable efforts to restore your data from backups in the event of data loss attributable to our systems.
• We are not liable for indirect, consequential, or incidental damages arising from your use of the Service.
• Our maximum liability for any claim is limited to the fees you paid us in the 3 months preceding the claim.
• You are responsible for verifying the accuracy of data entered into and generated by JobFlow, including AI-generated content and invoice calculations.

11. Indemnification

You agree to indemnify and hold harmless HYDRO TECH FORKLIFT, its directors, employees, and contractors from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

• You may terminate your account at any time through your Settings page.
• We may suspend or terminate your account for violation of these Terms, non-payment, or illegal activity.
• Upon termination, your right to use the Service ends immediately.
• Provisions relating to data ownership, intellectual property, limitation of liability, and indemnification survive termination.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

Consumers have rights under the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA). Nothing in these Terms limits your rights under applicable South African consumer protection legislation.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the JobFlow platform at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
